J. Palma Company, LLC ("JPC") takes the private nature of your personal information very seriously. This Privacy Policy describes how we treat the information we collect when you visit and use our service ("Service") available at GetRentCheck.com (the "Website"). Please read this notice very carefully.
INTRODUCTION
JPC is a New York company based in New York, New York. JPC owns and operates Service, which provides web-based tools and services that help subscribed Users self-manage their properties including but not limited to; organization, storage and action alerts for property information (basic financial and property data, lease, rent payment and tenant data). Subscribed Users can create and privately manage detailed property information and detailed property portfolio. The data that Subscribed Users want to access, use and display are stored as electronic files in individual electronic portfolios. Each portfolio has its own user-controlled security profile, thus allowing Subscribed User to control private access to specific portfolio information. Service offers browser based software tools and services. JPC's servers are located in the United States. All personal information provided to JPC is stored and processed in the United States. JPC values the privacy of the personal information of its subscribers, licensees, and other users of its Websites applications and/or Subscribed Users and JPC is committed to protecting the privacy of Users and Subscribed Users. JPC will not collect, use or disclose personal information except in accordance with this Privacy Policy.
WEBSITE VISITORS
Like most website operators, JPC collects non-personally-identifying information of the sort that web browsers
and servers typically make available, such as the browser type, language preference, referring site, and the date
and time of each visitor request. JPC's purpose in collecting non-personally identifying information is to better
understand how JPC's visitors use its Website and Service.
JPC also collects potentially personally-identifying information like Internet Protocol (IP) addresses. JPC does not
use such information to identify its visitors, however, and does not disclose such information, other than under the
same circumstances that it uses and discloses personally-identifying information, as described below.
LIMITING COLLECTION, USE AND DISCLOSURE
The Service permits Subscribed Users to store information with JPC, as part of the Service, and to make such information accessible to third parties chosen by the Subscribed User. Except for information selected and stored by Subscribed Users in Website, JPC will limit its collection of personal information to the amount and type of personal information which it needs for its identified purposes, and JPC will only collect personal information by fair and lawful means and not indiscriminately. Personal information will only be used or disclosed for the purposes for which it was collected, except with the consent of the applicable individual (which consent is implied by use of Website or Service for delivery of information to User-selected third parties) or as permitted or required by law.
AGGREGATED STATISTICS
JPC may collect statistics about the behavior of visitors to the Website. For instance, JPC may monitor the most popular pages on the Website. However, JPC does not disclose personally-identifying information other than as described below.
PROTECTION OF CERTAIN PERSONALLY-IDENTIFYING INFORMATION
JPC discloses potentially personally-identifying and personally-identifying information only to those of its employees,
contractors and affiliated organizations that:
(i) need to know that information in order to process it on JPC's behalf or to provide services available at the Website
or Service, and
(ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be
located outside of your home country; by using the Website or Service, you consent to the transfer of such information to them.
Other than to its employees, contractors and affiliated organizations or as described above, JPC discloses potentially personally-identifying and personally-identifying information only when required to do so by law, or when JPC believes in good faith that disclosure is reasonably necessary to protect the property or rights of JPC, third parties or the public at large. If you are a Subscribed User of Service or a User of Website and have supplied your email address, JPC may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what's going on with JPC and our products. If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it anonymously in order to help us clarify or respond to your request or to help us support other users. JPC takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.
For users outside the United States, please note that any personally-identifiable information you enter into the Website or Service will be transferred out of your country and into the United States. You consent to such transfer through your use of Website and/or Service. You also warrant that you have the right to transfer such information outside your country and into the United States.
Links to Third Party Sites
This Privacy Policy only applies to information collected by JPC. This Privacy Policy does not apply to the practices of companies that JPC does not own or control, or employees that JPC does not manage. Website and/or Service may contain links to third party websites. Any information you provide to, or that is collected by, third-party sites may be subject to the privacy policies of those sites, if any. We encourage you to read such privacy policies of any third-party sites you visit. It is the sole responsibility of such third parties to adhere to any applicable restrictions on the disclosure of your personally-identifying information, and JPC and its affiliates shall not be liable for wrongful use or disclosure of your personally-identifying information by any third party.
Security
Access to a Subscribed User's Service portfolios and information, maintained by JPC, is password-protected so that only Subscribed User may create and manage the Subscribed User's portfolio. All non-personally-identifying information, potentially personally-identifying and personally identifying-information described above is stored on restricted database servers.
RETENTION
JPC will retain personal information provided by a Subscribing User for Service tools and services for as long as the Subscribed User continues to subscribe to and remain a licensee of Service, and such Subscribed User maintains such information in the tools and services section. Otherwise, JPC will retain personal information provided by the Subscribed User only as long as is reasonably necessary or appropriate for the fulfillment of the purposes identified. Where personal information is no longer required to fulfill those purposes, JPC will use reasonable efforts to have it destroyed, erased or made anonymous.
ACCURACY AND RIGHT OF ACCESS
A Subscribed User has the sole right and power (except in very limited circumstances) to control the selection, correction, storage, access and
deletion of any personal information provided for storage in Website. Once information becomes part of an electronic portfolio in Service, a
Subscribed User generally will have exclusive control over the correction, continued storage, access and deletion of such information. Service
subscribers will have access, by logging in to the program, to all information stored in their electronic portfolios during the term of their
subscription, and such information may be corrected or deleted, as the Subscribed User may choose. Subscribed Users may also view and update
their personal account information by accessing the Subscribed User's account, available upon login to Service. The following paragraphs of
this Section of JPC's Privacy Policy ("Accuracy and Right of Access") only apply to personal information other than that stored by Users in
Website.
JPC will use reasonable efforts to ensure that other personal information under its control is as accurate, complete and up-to-date as is
necessary for the purposes for which it is to be used. Upon request, JPC will inform an individual as to whether or not JPC holds any
personal information about such individual and as to its use and disclosure of such information. If it is not possible to provide a list
of the specific organizations to whom information has been disclosed, JPC will provide a list of organizations to whom information may
have been disclosed. JPC will provide reasonable access to Subscribed Users who want to review their personal information maintained by
JPC, and to correct any inaccuracies or incompleteness in such information. Subscribed Users are solely responsible for the content and
information they provide/enter into Service and Website. Access to personal information also may be requested by emailing justin@getrentcheck.com
or by mailing a request to JPC. Individuals requesting access should receive confirmation of a request within 2-3 business days. JPC will respond
to an individual's request for access within a reasonable time. JPC's response will typically be provided at no cost to the individual, however,
JPC reserves the right, depending on the nature of the request, to charge the individual for its costs to process the request and to receive payment
of such costs prior to processing such request. If it is demonstrated that personal information is inaccurate or incomplete, JPC will amend the
information as required to the extent more accurate information is provided and, if appropriate, will advise third parties having access to the
information in question. If a challenge is not resolved to the satisfaction of the individual, JPC will record the substance of the unresolved challenge.
JPC is not responsible for verifying the continued accuracy of Users' personal information. In certain circumstances, JPC may be unable to provide
access to some or all personal information under its control. Those circumstances will be limited to those permitted or required by applicable law.
Where permitted, the reasons for such refusal will be provided to the individual upon request.
Choice/Opt-out
If JPC ever sends you information by e-mail concerning new products, services or information that you did not expressly request, we will provide you with an e-mail address by which you may request no further notices.
Privacy Policy Changes
Although most changes are likely to be minor, JPC may change its Privacy Policy from time to time, and in JPC's sole discretion. If JPC does, then JPC will notify you by posting the amended policy on the Website or by emailing you of the nature of the modifications along with a link to the modified document so that you can review it. In all cases, use of information we collect now is subject to the Privacy Policy in effect at the time such information is collected.
Review and Access
Upon your request, we will provide you with a summary of the information we collect about you. You will have the opportunity to correct, update, modify or delete this information by sending an e-mail to justin@getrentcheck.com. Please note that some information may remain in our records after deletion of your account.
